Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Agreement
Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Barilla Canada Pastaport Contest (the “Contest”) sponsored by Barilla Canada Inc. (the “Sponsor”) with contributions by Arterra Wines Canada, Inc. (“Arterra”) and Ruffino S.R.L ("Ruffino”). Please note: Arterra and Ruffino are prize suppliers only. Neither Arterra nor Ruffino nor their respective related companies, affiliates and subsidiaries are responsible for the promotion, administration or execution of this Contest, or the administration, use or misuse of any prize. By entering this Contest, entrants agree to completely release Arterra and Ruffino and their respective related companies, affiliates and subsidiaries from any liability.
By participating in the Contest, you signify your agreement to these Official Rules and the decisions of the Sponsor and RAVEN5 Ltd. (the “Administrator”). If you do not agree to the Official Rules, you may not enter the Contest.
2. Contest Period
The Contest begins at 12:00:01 AM Eastern Time (“ET”) on May 20, 2024 and ends at 11:59:59 PM ET on June 30, 2024 (the “Contest Period”). Administrator’s computer is the official timekeeper for the Contest.
3. Eligibility
The Contest is open to legal residents of Canada who are age of majority or older in their province or territory of residence the time of entry (“Participant”, “entrant” or “you”).
Employees, officers, directors, agents or representatives of the Sponsor, Administrator, Arterra, Ruffino, their parent companies and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, the “Contest Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each are not eligible to enter. In addition, the British Columbia Liquor Distribution Branch (“B.C.L.D.B.”), the British Columbia Liquor & Cannabis Regulation Branch (“B.C.L.C.R.B.”), their agents or representatives, liquor licensees or any distributor or company involved in any phase of Contest administration are not eligible to enter.
The Contest is subject to all applicable federal, provincial, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry will be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside Canada and wherever else prohibited by law.
4. How to Enter
There is no purchase necessary to enter the Contest. Making a purchase will not improve your chances of winning.
During the Contest Period, visit https://barillapastaport.ca (the “Contest Website”) and follow the instructions to complete the online entry form by providing your email address, first name, last name, province, postal code, and selecting your language preference. By providing your email address, you are providing consent to receive email communications from the Sponsor and Administrator relating to the administration of the Contest. Administrator will contact you by email if you are a potential winner of the grand prize. Each entrant will be required to complete and submit the online entry form prior to submitting a Bonus Entry (as further described below).
In addition to providing the above information, you must attest to full compliance with these Official Rules and your understanding that personal information collected is subject to Sponsor’s Privacy Policy (as further described below). Next, click “SUBMIT” to earn one (1) entry (a “Registration Entry”) into the grand prize drawing. Limit of one (1) Registration Entry per person during the Contest Period.
Bonus Entries: There are two (2) ways to earn bonus entries, which are extra ballots into the grand prize drawing. Please note: there is a total limit of five (5) bonus entries into the grand prize drawing, regardless of the method of entry.
i) Receipt Upload Bonus Entries (Purchase Method of Entry):
After submitting a Registration Entry, entrants may earn a bonus entry into the grand prize drawing by uploading a photo of a valid receipt that includes the purchase of at least one (1) Barilla product (”Receipt Upload Bonus Entry”).
To earn a Receipt Upload Bonus Entry, purchase an eligible Barilla product (or multiple eligible Barilla products) during the Contest Period, take a picture of the entire receipt showing the Barilla product(s), the date of purchase, and the retailer, upload the receipt to the Contest Website and, using the dropdowns, select the retailer it was purchased from, and (one of) the Barilla product(s) purchased and click “SUBMIT”. Entrants will earn one (1) bonus entry per receipt upload and submission (regardless of how many Barilla products are uploaded on one receipt) into the grand prize drawing for submitting a valid Receipt Upload Bonus Entry. All Receipt Upload Bonus Entries must be submitted on the Contest Website by 11:59:59 PM ET on June 30, 2024. Each receipt submitted by an entrant must be unique and must show all required information (as outlined above) to be considered valid. Each receipt must include a purchase made in Canada during the Contest Period. Only one (1) Receipt Upload Bonus Entry will be accepted each day during the Contest Period and each receipt must include a purchase made during the Contest Period. Multiple receipts submitted for purchases made on the same day will not be accepted. Receipt Upload Bonus Entries submitted after the end of the Contest Period will be void and will not be accepted into the Contest.
(ii) Opt-In Bonus Entries (No-Purchase Method of Entry): To earn bonus entries without making a purchase, after submitting a Registration Entry, entrants may earn a bonus entry into the grand prize drawing by visiting barillapastaport.ca/amoe and following the instructions to complete and submit the Opt-In Bonus Entry form.
The bonus entry form will require entrants to provide their first name, last name, email address, and a 50-word, unique and original write-up on the topic: “One thing I’d love to do or eat in Italy” and click “SUBMIT”. Entrants will earn one (1) bonus entry into the grand prize drawing for submitting a valid Opt-In Bonus Entry. Bonus Entries must include all requested information (as stated above), and the email address submitted with the Opt-In Bonus Entry must match the email address submitted on the entrant’s Registration Entry to be considered valid. Opt-In Bonus Entries become the property of the Sponsor and will not be returned. Requests for confirmation of receipt of Opt-In Bonus Entries will not be acknowledged.
Entrants may only submit one (1) Receipt Upload Bonus Entry or one (1) Opt-In Bonus Entry per day during the Contest Period, up to a total of five (5) Receipt Upload Bonus Entries and/or Opt-In Bonus Entries during the Contest Period.
There is a limit of five (5) Receipt Upload Bonus Entries and/or Opt-In Bonus Entries combined per person during the Contest Period. For clarity, entrants may submit either:
Total limit of six (6) entries per person into the Contest, inclusive of bonus entries.
Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Registration Entry. For the purpose of these Official Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet service provider or other organization responsible for assigning the submitted email address. Each selected entrant may be required to provide the Sponsor with proof that the selected entrant is the authorized account holder of the email address associated with the selected entry. In the event of a dispute as to the identity of a selected entrant based on the email address, the selected entrant will be deemed to be made by the authorized account holder of the email address at the time of entry.
Entries which are incomplete, illegible or fraudulent are null and void. Anyone found to use multiple accounts to enter will be ineligible. The Sponsor accepts no responsibility for entries that are lost, misdirected or delayed for any reason. Further, the Sponsor accepts no responsibility for incomplete entries, the incorrect or inaccurate capture of entry information, including but not limited to as a result of malfunction, human error, lost, delayed or garbled Internet or email transmission, omission, interruption, deletion, defect or failures of any telephone, technical, network, online, hardware or software or any combination thereof.
5. Grand Prize / Approximate Retail Value (“ARV”) / Odds of Winning
One (1) Grand Prize is available to be won, including $6,000 CAD cash (which may be used towards the cost of flights to Italy and accommodations for two (2) people) and a Ruffino VIP wine tour in Italy for two (2) people (booking details and exact timing TBD and arranged by Arterra, $1,000 CAD value).
The ARV of the Grand Prize is $7,000.00 CAD.
Odds of winning the Grand Prize will depend upon the total number of eligible entries received during the Contest Period.
Grand Prize Conditions
The winner of the Grand Prize must book the Ruffino VIP wine tour by December 31, 2024.
To receive the $6,000 CAD cash prize, Grand Prize winner agrees to coordinate with Sponsor’s marketing agency, Zeno Group Canada over email and/or phone communication and provide ALL necessary details in Zeno Group Canada’s Vendor Management System, which winner will be sent an invitation to access, including a bank void cheque/direct deposit form, in order to receive payment via direct deposit. Failure to do so within seven (7) days of the request may result in the Grand Prize being forfeited.
Grand Prize winner is solely responsible for any and all trip facilitation and booking aside from the Ruffino VIP wine tour, which a Ruffino representative will help the winner book. All bookings and reservations may be subject to additional terms and conditions, availability and blackout dates. Winner and guest are responsible for all required travel documents and identification. Any additional costs for travel, hotels, food, expenses over and above the $6,000 CAD cash prize are the sole responsibility of the winner. Additional conditions may apply.
Sponsor, is not responsible for any cancellation, delay or rescheduling of flights or wine tour. Moreover Arterra and Ruffino are not responsible for any cancellation, delay or rescheduling of the wine tour caused by the Grand Prize winner or a delay in flights; and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner. Winner is responsible for the payment of any applicable airline excess baggage fees or other fees, taxes and surcharges. All other expenses not specified herein, exceeding the $6,000 CAD cash prize, with respect to the Grand Prize are the sole responsibility of the winner, including but not limited to applicable taxes, fuel/currency surcharges, airport transfer transportation, meals and alcoholic beverages, room service, gratuities, merchandise, telephone calls, medical and travel insurance, any required travel documentation, and all personal expenses of any kind or nature.
It is the sole responsibility of the Grand Prize winner and his/her guest to obtain all necessary travel documentation including passports and visas as applicable and to comply with any customs and immigration requirements. Winner and his/her guest are responsible for ensuring they are able and allowed to legally enter the country and/or countries included in the Grand Prize.
The Sponsor, in its sole discretion, reserves the right to substitute prizes of equal or greater value if advertised prize become unavailable. The Sponsor’s determinations regarding the awarding of the Grand Prize is final. No prize substitutions except as provided herein. The Grand Prize is not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value.
All details and other restrictions of the Grand Prize not specified in these Official Rules will be determined by the Sponsor in its sole discretion. Actual value of the prizes under this Contest may be lower or higher at the time of fulfillment, and any difference between actual value and the stated ARV (if actual value is lower than stated ARV) will not be awarded. The Sponsor is not responsible if any element of a prize is delayed, postponed or cancelled for any reason. Prizes are non-transferable, non-refundable, and no substitution or cash redemption will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right, for whatever reason, to substitute a prize (or any component thereof) for one of equal or greater value. Winner must be able to accept the prizes as presented or the respective prize will be forfeited in its entirety and an alternate potential winner may be selected for the prize in Sponsor’s sole discretion. Any applicable taxes and duties on a prize are the sole responsibility of the winner.
By accepting a prize, winner agrees to release the Contest Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Contest or for damages of any kind caused by a prize or resulting from acceptance, possession, or use/misuse of the prize awarded.
6. Winner Selection and Notification
Administrator will select the potential Grand Prize winner in a random drawing conducted at Administrator’s offices. Administrator’s decisions are final. One (1) potential Grand Prize winner will be selected from all eligible entries received during the Contest Period on or about July 3, 2024.
The potential winner will be notified by a designated representative of the Administrator using the email address provided by the potential winner in their Registration Entry. The designated representative will make a minimum of two (2) attempts to contact the potential winner within seventy-two (72) hours of the drawing date.
If an eligible potential winner cannot be contacted within seventy-two (72) hours of the drawing date, if the prize is declined, or if there is a return of any notification as undeliverable; then the potential Grand Prize winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the prize) and the Sponsor reserves the right, in their sole and absolute discretion to randomly select an alternate eligible entrant for the Grand Prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
No one is a winner unless and until the Sponsor officially confirms him/her as a winner in accordance with these Official Rules.
Before being confirmed as a winner, the potential winner will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility & Liability / Publicity Release form (the “Release") which confirms the Winner’s: (i) eligibility for the Contest and compliance with these contest Official Rules; (ii) acceptance of the Grand Prize as offered; and (iii) release of the Sponsor, Arterra, Ruffino, the Administrator, B.C.L.D.B., B.C.L.C.R.B. and their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, or losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom.
In addition, the potential winner must correctly answer a time-limited skill-testing question without any assistance in order to become a winner. The skill-testing question may be part of the Winner Release or may be provided separately.
7. Limitation of Liability
By participating in the Contest and as a condition of acceptance of a prize, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Releasees from and against any and all loses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation any and all costs and liabilities of any kind including but not limited to lawyer’s fees), and including, without limitation, any such arising from any act of negligence of the Releasees, that the entrant now has, or may hereafter have against the Releasees directly or indirectly resulting from participation of the Contest or the awarding, acceptance, use, or misuse of a prize. Winner assumes all liability for any injury or damage caused or claimed to be caused by participation in this Contest or use/misuse or redemption of the prize.
8. General
The Provincial liquor agencies are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever in regard to any matter that relates to this Contest.
The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. Further, the Sponsor is not responsible for incompatibility of Participants’ hardware, software or browser technology. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials or communications, privacy policy or terms of use on the Contest Website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute determination.
The Releasees are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Contest.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE THE WEBSITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
By participating in the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsor, which are final and binding in all matters relating to the Contest.
Failure to comply with these Official Rules may result in disqualification from the Contest. The Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest). If for any reason this Contest is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest, at which time, the Sponsor will conduct a random drawing from among all eligible entries received at the time of the Contest termination.
Sponsor reserves the right to terminate or amend this Contest, in whole or in part, without prior notice except to the B.C.L.D.B. Any termination will be subject, in British Columbia to the approval of the B.C.L.D.B.
9. Disputes
Except where prohibited, Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
10. Privacy
By participating in the Contest, each entrant: (i) grants to the Sponsor the right to use his/her personal information provided when he/she enters the Contest for the purpose of administering the Contest, including but not limited to contacting and announcing the winner and coordinating the Grand Prize; (ii) acknowledges that the Sponsor may disclose his/her Personal Information to service providers of the Sponsor in connection with any of the activities listed in (i) and/or (ii) above.

11. Winners List Requests
To request a copy of the winners list (available after July 12, 2024) send an email to [email protected] with subject line: Barilla Canada Pastaport Contest Winners List Request. All requests must be received by August 31, 2024 at 11:59:59 PM ET. Requests received after this time will not be fulfilled.
